GENERAL TERMS AND CONDITIONS

By using this website, you hereby accept and agree with the indicated General Provisions.

These GENERAL PROVISIONS shall settle the relationships between TILKOM OOD, with UIC: 121871118  (TILKOM OOD) and the Users of electronic (Internet) pages and services, situated on the domain www.tilcom-bg.com and its sub-domains (the Site) and using the information and trade services, offered by TILKOM OOD (Service/s) of the Site.

1. Terms and conditions for the Site of TILKOM OOD

By using this Site, the User hereby confirms and declares its agreement with the following:

• The information services of the Site shall be presented “as they have been published”. TILKOM OOD shall not be responsible for the precision of the information published.
• TILKOM OOD shall not be responsible for and shall not commit to deadlines for providing information regarding applications made by the Consumer, completed orders, the status of its queries or the queries of other Consumers, questions and comments about products, availability of products and damage and/or opportunity costs suffered and other losses of any other type or amount, which have occurred after, as the result of or due to the use / impossibility of using (due to technical issues, prophylactics, decisions of the administrator, etc.) of the Site.
• TILKOM OOD shall not be responsible in cases when using the Site or materials from the site result in damages to the consumer, for which repair or correction of equipment or loss of information have occurred, and all expenses related to the removal of such faults shall be at the expense of the Consumer.

• The full information regarding the goods, presented at the site, which have not been produced by TILKOM OOD, for example technical characteristics, warranty conditions, method of use, etc. has been presented by the producer, respectively by the importer of the respective goods, and TILKOM OOD shall not be responsible in any way in case of untrue, incorrect or imprecisely presented information, correct information provided in a misleading manner, discrepancy between the presented and actual location, printing errors.
• The goods published on the website are illustrative. Discrepancy with the actual parameters is possible.

2. Personal data protection

• TILKOM OOD, UIC: 121871118, in its capacity as Personal Data Administrator, shall receive personal data from the persons they refer to.

• TILKOM OOD is a personal data Administrator, established in the territory of the Republic of Bulgaria and shall process lawfully and in good faith personal data in relation to the objectives of its activity – wholesale and retail trade of goods and shall not process them additionally in a manner incompatible with these objectives.
• The recipients or categories of recipients that personal data has to be disclosed to are natural persons that the data refers to, or other persons, if this is stipulated in a regulatory act or resulting by a contractual agreement between the Consumer and the Administrator. The personal data presented by the Consumer shall not be ceded to third parties for advertising and promotional purposes.
• Personal data provided by the Principal and the personal data that TILKOM OOD receives in the process of providing its commercial services shall be processed and preserved by TILKOM OOD in compliance with the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament) and the Personal Data Protection Act. Detailed information about the objectives and the legal grounds for processing personal data; categories of personal data recipients; the term for storage personal data; the rights of the data subjects in relation to the processing of its personal data by TILKOM  OOD and information about the method they can be exercised with; contact details and all other information that the General Data Protection Regulation requires to be provided to the Consumers, shall be contained in the Privacy Policy of TILKOM OOD, which has been published on the web-page (“the Policy”).

3. Copyright and restrictions related to copyrights.

The Consumers can use all services offered at the Site under the condition that copyrights of TILKOM OOD or third parties related directly or indirectly to the materials on the Site shall not be breached. Copying and public disclosure of materials published on this Site by the Consumers for any purpose is explicitly prohibited, except with the express written agreement by TILKOM OOD.

TILKOM OOD retains the right to cede the rights for publication of materials and other information published on the Site to third parties under additionally concluded agreement in writing, which settles the legal relationship between TILKOM OOD and the person, publishing the information.

For purchasing goods representing the object of copyright and/or patent rights, TILKOM OOD shall not provide any additional rights to use or dissemination, other than the expressly indicated rights and/or licenses by the producer/distributor of the goods.

The links of the Site to other sites, property of third parties, have been published for convenience of the consumers. In case of using such reference, the consumers shall not use a service provided by TILKOM OOD and as regards to the use of the reference outside of the Site, these General Terms and Conditions shall not apply.

TILKOM OOD shall not be responsible as regards to the information and/or the content of other sites, property of third parties, and the use of these sites or the information contained therein shall not be necessary and shall not be recommended. Any possible risks related to the use of such sites shall be borne by the Consumers.

4. The goods and services provided to the Site.

The information about the goods in the Site is distributed per type of groups and sub-groups;

In the page (link) to each catalog of products, shown in the Site, information is presented regarding the main characteristics of the goods and additional information, having the objective of supporting the making of an informed choice by the Consumers when purchasing the product. TILKOM OOD shall not be responsible for inconsistencies in the description of the goods, which do not refer to the main characteristics of the goods and does not make any claims as to the exhaustiveness of the information presented.

TILKOM OOD shall retain the right to publish names, models and other information about goods in English or another language, when:

a) There is a risk regarding losing valuable information about the characteristics of the goods in the process of translation;

b) There is no universally accepted unambiguous terminology in Bulgarian language;

c) The goods themselves are information media in English or in any other language

5. Cookies policy

With the purpose of improving effectiveness, the electronic platform of the Site TILKOM OOD shall use data files of the type “cookies”. Processing and storage of cookies data shall be performed in compliance with the provisions of the General Data Protection Regulation and the Cookies Policy of TILKOM OOD, which is published on www.tilcom-bg.com.

6. Other

TILKOM OOD shall have the right to change ex parte all terms and conditions and all of the information, published on the Site, without advance notice to the Consumer.

TILKOM OOD shall reserve its right to send the right to send the Consumer messages related to new products and services, with promotions and/or with changes in the terms and conditions for delivery of the goods presented and any other information, published on the Site, after consent has been provided by the Consumer.

These General Terms and Conditions may be updated at all times, and their publication on the Site shall be considered notifying the consumers about the changes. When using the Site, the Consumers shall comply with these General Terms and Conditions, and the laws in force of the Republic of Bulgaria, applicable for the goods and services offered on the Site, including the international laws.

THE USER SHALL AGREE WITH THE TERMS AND CONDITIONS FOR USING THE SERVICES OF TILKOM OOD BY PRESSING (CLICKING) ON EACH OBJECT, LINK OR BUTTON ON THE SITE, AS WELL AS WITH THE LINK TO THE GENERAL TERMS AND CONDITIONS AND IT SHALL BE CONSIDERED THAT IT IS FAMILIAR WITH THE GENERAL TERMS AND CONDITIONS OF THE VENDOR, HAS ACCEPTED THEM AND SHALL AGREE TO COMPLY WITH THEM.
